Terms and conditions

These Terms & Conditions govern all sales of artworks by LDN Art Ltd (“LDN”, “we”, “us”, “our”), whether concluded via our website, by email or telephone, in person, or through private sale.
By purchasing from LDN, you agree to the following terms.
1. Formation of Contract
A binding contract is formed only when LDN confirms acceptance of a sale in writing and receives either a deposit or full payment in cleared funds.
Automated website confirmations or acknowledgements do not constitute acceptance of an order. Until written confirmation is issued, LDN reserves the right to withdraw an artwork from sale.

3. Pricing & Payment
All prices are stated in Pounds Sterling (£) unless otherwise specified. VAT will be applied where required by law. Certain secondary market works may be sold under the Margin Scheme.
A deposit may be required to reserve an artwork. Full payment must be received in cleared funds prior to release or delivery. Where staged payments are agreed, the schedule will be confirmed in writing.
Failure to complete payment within the agreed timeframe may result in termination of the sale and retention of any deposit paid.
4. Title & Risk
Legal title to an artwork passes only once full cleared funds have been received.
Risk transfers upon collection by the buyer or delivery to the agreed shipping provider. Buyers are responsible for arranging appropriate insurance from that point.
5. Description & Condition
Artworks are sold in their present condition.
Condition reports are available upon request and reflect professional opinion at the time of inspection. All statements regarding attribution, provenance, exhibition history, and authenticity are made in good faith and in accordance with standard art market practice.
Prospective buyers are encouraged to undertake independent due diligence prior to purchase.
6. Authenticity
LDN warrants that it has good title to the artwork or authority to sell it.
Should an authenticity dispute arise, supported by recognised expert opinion, the buyer’s sole remedy shall be rescission of the sale and refund of the purchase price. Any such claim must be made within five (5) years of the date of purchase.
No further warranties are provided.
7. Consumer Cancellation Rights
Where a buyer qualifies as a consumer and purchases remotely, statutory cancellation rights under the Consumer Contracts Regulations 2013 may apply.
Notice of cancellation must be given within fourteen (14) days of delivery. The artwork must be returned in its original condition, and return shipping and insurance are the responsibility of the buyer unless the work has been materially misdescribed.
Bespoke or commissioned works are non-refundable.
8. International Sales
For international transactions, buyers are responsible for import duties, customs clearance, local taxes, and compliance with applicable regulations in their jurisdiction.
LDN is not responsible for delays caused by customs authorities or international carriers.
9. Artist’s Resale Right
Where applicable under the Artist’s Resale Right Regulations 2006, resale royalties will be handled in accordance with statutory requirements.
10. Anti-Money Laundering
As a regulated art market participant, LDN complies with the UK Money Laundering Regulations 2017.
For qualifying transactions, identification and source-of-funds documentation may be required prior to completion. LDN reserves the right to decline or suspend a transaction pending satisfactory compliance.
11. Intellectual Property
Copyright in artworks remains with the artist unless expressly transferred in writing.
Purchase of an artwork does not grant reproduction or commercial usage rights.
12. Market Position
13. Liability
LDN’s total liability in connection with any sale shall not exceed the purchase price paid.
Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by negligence.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the English courts.
